Interplay’s Privacy Policy is intended to help you understand the information we may collect and how it may be used or shared.  This Policy applies to Interplay’s services, including but not limited to its websites, stores, games, applications, or other products or services that link to this Policy.  You may also be subject to additional terms of service or use, depending on how you use or interact with our services, products, or websites.  Please carefully read and make sure you understand and agree to all applicable Terms before using Interplay’s services. 

1. Information We Collect

Our offerings and services may change from time to time and the ways you provide us with information may also change as a result.  Some examples of the most common situations in which you may provide information to us are:

A.    Information You Give Us Directly

We collect information that you directly provide to us, including but not limited to:

  • Information you provide when seeking help from us, such as your name, telephone number, and records (including call recordings) of the issues you experience

  • Information you provide in response to surveys about our games or services

B.     Other Information We Collect When You Use Our Services

We may collect other information automatically when you use our services, including but not limited to:

  • IP address;

  • Information about your device, hardware, and software, such as your hardware identifiers, platform type, settings and components, Interplay software and updates you have installed, and the presence of required plugins;

  • Approximate geolocation data (derived from IP or device settings);

  • Browser information, including your browser type and the language preference;

  • Referring and exit pages, including pages viewed and other interactions with web content;

  • Details about what Interplay games or services you purchase or obtain, and your use of them; and

  • Device event information, including crash reports, request and referral URLs and system activity details (e.g. whether you encountered an error playing our games or lost Internet access).

We also may collect and store information locally on your device, using mechanisms like cookies, browser web storage (including HTML 5), and data caches of our games and applications. 

 

Some features of our games and services may be provided by third parties that may also use automated means of data collection and may record information about your use of our services or others’ websites over time. These features are subject to those third parties’ privacy notices and policies.

 

Our website, games or other services may contain links to the websites, games, or services of third parties not controlled by us.  If you choose to visit, interact with, or use these third party sites, games, or services, we are not responsible for their privacy practices or contents, and it is your responsibility to review the privacy and data collection policies of those third parties to confirm that you understand and agree with their policies.

C.     Information Provided to Us by Third Parties

Mobile Platforms. If you play or purchase our games on a mobile device or tablet, we may receive information about you from app stores or other mobile platform providers, including your username and/or device ID and the fact that you made a purchase.  The information we receive does not include any sensitive or financial information. Some of our mobile platforms may send information to us that you authorize them to provide. Our mobile games also may request additional personal information from you, such as push notification tokens, your device location, or contact list, and we will collect this information only if you give us your consent.

Other Third Parties. We may receive information from third parties, like Apple Game Center, when you use these services with our games. We may also receive information about you when other players choose to share their contact lists with us. 

If you interact with us on a website or app we do not control, that website or app may allow access to certain information about you. For example, social networks may provide us with information from your profile on their services or other information that you agreed the social network or other party could provide to us.

2. How We Collect Information

We and third parties use technologies described below to collect information to deliver our Services.

Cookies and Similar Technologies
We use cookies, tracking pixels or clear GIFs, and similar technologies, to collect information about your use of our services to help us understand things like what web pages, features, or ads you view and what games you play. You can disable cookies, limit the types of cookies you allow, or set your browser to alert you when cookies are being sent. Please review the guidance provided by your individual web browser to manage your cookie preferences. We may also offer cookie consent tools to help you manage your cookies.

Internet log files contain technical data such as your IP address and we may use such information to monitor traffic on our services, troubleshoot technical problems, detect and prevent fraud, and enforce our Terms of Service agreement. You may opt out of certain types of tracking on the web, including certain analytics and tailored advertising by changing the cookie settings in your browser or via our consent tools.

3. How We Use Your Information

We may use your personal information, both individually and aggregated together with other users:

To operate our business and improve or personalize your experiences with our games, products, and services, including to:

  • Operate, improve, and develop our games and services;

  • Provide and determine the effectiveness of advertising;

  • Monitor the performance of our services;

  • Facilitate game play across multiple devices, where applicable;

  • Promote and provide contests;

  • Identify, fix, and troubleshoot bugs or functionality errors;

  • Provide software updates;

  • Perform audits, transactions, and other compliance activities;

  • Help maintain safe and fair services;

  • Resolve disputes;

  • Help deter fraud, abuse, or illegal behavior;

  • Comply with the law

  • Enforce our agreements, policies, and terms of use or service;

  • Other purposes you consent to, are notified of, or are disclosed to you when you provide personal information

To provide support, including to:

  • Identify, toubleshoot, and correct problems with our games and services; and

  • Respond to your specific requests and questions.

The information we collect will be retained for as long as necessary to provide our services and operate our business, and may be retained for longer periods as necessary for legal, regulatory, operational, or other legitimate business reasons.

 

In some instances, the information we collect may be de-identified, anonymized and aggregated so that it does not directly identify any individual. In that case, we may use and share such information as necessary for our business purposes to the extent permitted by applicable law.

4. Information Shared With Third Parties

We do not share, sell (as that term is defined under applicable privacy laws, such as the California Consumer Privacy Act), or disclose your personal information, except as described in this policy. For a list of the categories of personal information we have sold or disclosed about consumers for a business purpose in the past 12 months, please contact us as set forth in Contact Us Section below.

Third Party Service Providers. We may employ third parties located in and outside of your country of residence (including outside of the European Economic Area (EEA)). These service providers may collect or process personal information on our behalf for the purposes outlined in Section 3 above, including but not limited to conducting market surveys, providing IT and related services, facilitating credit card processing, or sending emails. We require that any third party employed for these purposes use the data only on our behalf and in a manner consistent with this policy.

 

Business partners. We may provide personal information to business partners, including but not limited to, companies such as Sony, Microsoft, Nintendo, or others.

Affiliates. We may share personal information with our affiliated companies.

When necessary to protect ourselves or others. We may access, preserve, and disclose any information we store associated with you to external parties if we, in good faith, believe doing so is required or appropriate to:

  • comply with law enforcement or national security requests;

  • comply with legal process, such as a court order or subpoena;

  • protect your, our or others' rights, property, or safety;

  • enforce our policies or contracts;

  • collect amounts owed to us; or

  • assist with an investigation or prosecution of suspected or actual illegal activity.

If we are subject to a merger, sale, or other asset transfer. If we engage in a reorganization, merger, sale or other divestiture, or bankruptcy, we may transfer all information we collect to the relevant third party and will obtain your consent to do so if required by law or contract.

Upon Your Consent. We may share information with other third parties with your express consent, unless otherwise described above. In those cases, use of the information you agree to share will be subject to and governed by those third parties’ privacy policies.

 


5. Where We Hold Information; Transfers

When we collect information, it may be stored and processed for the purposes set out in this Privacy Policy in the United States or any other country in which we, our subsidiaries, or our third-party agents operate. By consenting to the transfer of your personal data outside of your country of residence, you acknowledge that your personal information may be transferred to recipients in the United States and other countries that may not offer the same level of privacy protection as the laws in your country of residence or citizenship.

 


6. How We Protect Your Information

We maintain appropriate administrative, technical, and physical safeguards to protect your personal information from accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure, or use and other unlawful forms of processing. In some cases, your information is accessible when you log into a feature we offer, and in those cases you need to keep your user credentials and password confidential and secure so that your information is protected. Even so, no security measure is 100% perfect. We cannot guarantee the security of your information and do not assume any responsibility for the unauthorized use or access to your information under our control.

 


7. Your Choices and Controls

EEA and UK Residents. If you are an EEA or UK resident, you may have the right to access your information, the right to correct your information, the right to request deletion of your personal information, the right to request restricted processing of your personal information, the right to a portable copy of the personal information you have provided, and the right to object to processing of your personal information, such as for direct marketing. You may also contact us at that address with any questions or concerns about our handling of personal information. You may also lodge a complaint with a data protection authority if you have concerns about our handling of personal information.

California Residents. California residents who are not job applicants, employees, or employees of another company interacting with us in the scope of their job, have a right to ask us what personal information we have collected and shared about them, the right to request deletion of their personal information, and the right not to be discriminated against for exercising any of these rights. 8. Children’s Privacy

We intend for our services to be appropriate for general audiences and they are not directed at children (depending on where you reside, this usually means children under age 13). Interplay does not intentionally collect personal information from children without seeking any required parental approval per applicable law and regulations, such as the U.S. Children’s Online Privacy Protection Act (“COPPA”).

We may ask users of our services to provide age-related information, such as a date of birth, to comply with laws like COPPA and to determine whether such laws or regulations require us to obtain verifiable parental consent from your parent or guardian before allowing you to access our services.

If you are a parent or guardian and wish to revoke your previously provided consent, review information collected from your child or have that information deleted, please contact via the options in the Contact Us Section below. If we become aware that a child has provided us with personal information, we will delete any personal information we have collected, unless we have a legal obligation to keep it, and terminate the child's account and/or revert them to the underage experience, as applicable.

If we make material changes to how we collect, use, share or otherwise process your child's personal information, we will notify parents by email or by other means as required by applicable law.

 


9. Updates to Our Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or relevant laws. You can see the last date this policy was updated at the top of this page. Please review this policy every time you access or use our services to make sure that you have reviewed the most recent version.
